referDot Pro Owner Messaging & Communications Responsibility Policy

Version 2026-10-05.1 · Last updated 10/5/2026

Workspace owners must accept this policy before activating a referDot Pro workspace. It places legal responsibility for email, SMS, and other client messaging on the workspace owner — not on referDot.

1. Who this policy covers

This policy applies to every referDot Pro workspace owner (and any person who creates or activates a workspace). By accepting, you bind yourself and the business you represent. Team members may use the workspace only under your authority and responsibility.

2. You are the sender; referDot is the platform

referDot provides software and delivery infrastructure (including email and SMS tooling). When your workspace sends or schedules email, SMS, follow-ups, automations, or other messages to clients or third parties, you and your business are the sender and controller of that content and audience. referDot is not the originator of your marketing or client communications and does not assume responsibility for your lists, consent, content, timing, or compliance.

3. Consent, opt-in, and opt-out

You alone are responsible for obtaining and retaining all legally required prior express consent (including TCPA, CAN-SPAM, CASL, GDPR/UK GDPR, and similar laws) before emailing or texting anyone. referDot records each client’s email and SMS preference on their workspace profile, appends STOP language on first SMS, and includes email unsubscribe links on Pro follow-ups. When a client replies STOP or uses unsubscribe, those preferences are updated and further marketing-like follow-ups to that channel are blocked. You must not override or ignore those preferences. You must not import or message contacts without a lawful basis and valid consent where required.

4. Content and prohibited use

You are solely responsible for message content, claims, promotions, referral offers, and attachments. You must not use referDot to send unlawful, deceptive, harassing, abusive, or spam content; to violate carrier or provider rules; or to message minors where prohibited. You will not misrepresent referDot as the sender of your business messages.

5. Quiet hours, scheduling, and volume

You control when messages send (including schedules, automations, and silent-time settings). You are responsible for time-zone choices, quiet hours, frequency, and volume. referDot may apply technical limits or refuse delivery for abuse or provider rules, but that does not shift legal responsibility for your campaigns onto referDot.

6. Client data and privacy

Client names, emails, phones, referral codes, and related records you store or process in your workspace are your responsibility. You must provide any notices and honor privacy rights required for your business. referDot processes such data as a service provider / processor to operate Pro features, as described in the referDot Privacy Policy.

7. Indemnification and allocation of risk

To the fullest extent permitted by law, you agree that referDot, Dirtydegree, and their affiliates, officers, and agents are not liable for claims, fines, carrier filtering, chargebacks, or damages arising from your messaging, lists, consent practices, or content. You will defend and indemnify them against third-party claims arising from your use of Pro messaging (email, SMS, or otherwise), except to the extent caused by referDot’s willful misconduct.

8. Record of acceptance

When you accept this policy, referDot records your acceptance for compliance and dispute purposes, including policy version, date and time (UTC), your user account, workspace name, IP address, user agent, and related metadata. That record is retained by referDot platform administrators and is not shown in your workspace activity logs.

9. Updates

referDot may update this policy. Material updates may require you to re-accept a new version before continued activation or messaging use. Continued use after a required re-acceptance deadline constitutes acceptance only if we present the new version for signature; otherwise you must sign again in-product.

10. Relationship to Terms of Service

This policy supplements the referDot Terms of Service and Privacy Policy. If there is a conflict about Pro workspace messaging responsibility, this Owner Messaging & Communications Responsibility Policy controls for that subject.
